Upper Darby Township regulates the possession, use, sale, and display of fireworks in accordance with Chapter 303 of the Township Code, the Pennsylvania Fireworks Law, and applicable public safety standards.

Fireworks regulations are intended to protect public safety, prevent fires, and ensure that fireworks are used in a lawful and controlled manner.

It is unlawful to possess, use, or display fireworks in violation of Township regulations.


Types of Fireworks

Consumer Fireworks

Consumer fireworks are small-scale fireworks intended for use by the general public and must comply with federal and state safety standards.

Consumer fireworks may be purchased, possessed, and used by individuals who are:

  • At least 18 years of age
  • In compliance with all Township and State requirements

Display Fireworks

Display fireworks are large, professional-grade fireworks designed for public displays and are not permitted for general use by the public.

Display fireworks may only be used by qualified individuals and require a Fireworks Permit issued by the Township.


Consumer Fireworks – Use Regulations

The use of consumer fireworks within Upper Darby Township is subject to the following restrictions:

Consumer fireworks may not be ignited or discharged:

  • On Township streets, sidewalks, parks, or other Township-owned property
  • On private property without permission of the property owner
  • From or within a motor vehicle or building
  • Into or at a vehicle, structure, or another person
  • While under the influence of alcohol, controlled substances, or drugs
  • Within 150 feet of an occupied structure

Time Restrictions

Consumer fireworks may not be ignited or discharged two (2) hours or later after sunset, as determined by the National Weather Service.


Fireworks Safety in a Densely Populated Community

Upper Darby Township is one of the most densely populated communities in Pennsylvania. The use of fireworks in close proximity to homes, buildings, and neighboring properties presents significant risks, including fire hazards, personal injury, and property damage.

Even when used legally, fireworks can pose serious safety concerns in densely developed residential areas where:

  • Structures are located in close proximity to one another
  • Limited setbacks increase the risk of fire spread
  • Occupied homes, vehicles, and pedestrians are nearby
  • Emergency access and response may be impacted

Residents are strongly encouraged to exercise caution and responsibility when using consumer fireworks.

Safe use practices include:

  • Maintaining safe distances from structures and neighboring properties
  • Ensuring that fireworks are not used in confined or congested areas
  • Supervising all use to prevent unsafe handling or misuse
  • Avoiding use during dry, windy, or hazardous conditions
  • Being mindful of neighbors, including children, the elderly, and pets

The Township’s public safety officials strongly encourage residents to prioritize safety and consider attending permitted, professionally conducted fireworks displays as a safer alternative.

Improper or unsafe use of fireworks may result in dangerous conditions and may violate Township regulations.


Sale and Storage of Consumer Fireworks

The sale and storage of consumer fireworks is regulated by the Pennsylvania Department of Agriculture.

Any person intending to sell or store consumer fireworks within Upper Darby Township must:

  • Provide proof of proper State licensure
  • Comply with all applicable Township regulations

Fireworks Permits (Display Fireworks Only)

A Fireworks Permit is required for the possession and use of display fireworks within Upper Darby Township.

Permits are issued by the Township and are subject to strict requirements to ensure public safety.


Who May Apply for a Fireworks Permit

Fireworks permits for display fireworks may only be issued to:

  • Individuals who are at least 21 years of age
  • Qualified operators or organizations conducting lawful displays
  • Business entities performing or supervising fireworks displays for profit (with required State registration)

When a Fireworks Permit is Required

A Fireworks Permit is required for:

  • Public fireworks displays
  • Organized events involving display fireworks
  • Ceremonial or athletic events involving display fireworks
  • Agricultural, industrial, or signal-related uses involving display fireworks

Display fireworks may not be used without an approved Fireworks Permit.


Application Requirements

Fireworks Permit applications must:

  • Be submitted in writing at least 30 days prior to the planned display
  • Include all required information regarding the display
  • Be accompanied by the applicable permit fee

Incomplete or late applications may not be considered.


Permit Conditions and Approval

Each fireworks display must meet the following requirements:

  • The display must be conducted by a competent operator
  • The display must be properly located and conducted in a manner that does not pose a hazard to persons or property
  • The display must be reviewed and approved by the Township in coordination with appropriate public safety officials

Display fireworks may not be ignited within 300 feet of a facility licensed to sell consumer fireworks.


Bond Requirement

The Township requires a bond from the permittee in an amount not less than $50,000.

The bond is required to ensure payment for any damages that may occur to persons or property as a result of the fireworks display.


Permit Extensions

If a fireworks display cannot occur due to weather or other conditions:

  • A request for extension may be submitted within 24 hours
  • The request must include:
    • Reason for postponement
    • Proposed new date (within one week of original date)

If approved, the permit may be extended without additional fees or bonding requirements.


Additional Requirements

Depending on the event and location, additional approvals may be required, including:

  • Police coordination and staffing
  • Fire Department standby requirements
  • Traffic control or road closures
  • Site inspections prior to the event

Applicants are responsible for coordinating all required approvals.


Important Reminders

  • Consumer fireworks are permitted only in accordance with Township regulations
  • Consumer fireworks may not be used on public property
  • Consumer fireworks must not be used within 150 feet of an occupied structure
  • Consumer fireworks may not be used late at night (2 hours after sunset restriction)
  • Display fireworks require a Fireworks Permit and Township approval
  • Fireworks displays must be conducted by qualified operators
  • Fireworks must not be used in a manner that endangers persons or property
