Upper Darby Township – Community FAQ Federal Immigration Enforcement (ICE) 

Why is the Township issuing this information now? 

Upper Darby Township is sharing this information in response to community concerns about federal immigration enforcement activity and recent changes in how ICE communicates with local governments. Our goal is to provide clear, accurate information and reduce fear or misinformation. 

Is ICE operating in Upper Darby Township? 

Immigration and Customs Enforcement (ICE) is a federal agency that operates independently of Upper Darby Township. The Township does not control when or where ICE conducts its activities. The Township Police Department has been notified that any communication with ICE should be handled via the federal Freedom of Information Act (FOIA) process. 

Is Upper Darby Township working with ICE? 

No. Upper Darby Township does not participate in civil immigration enforcement and does not have an agreement authorizing Township police officers to enforce federal immigration law. 

What does the Township Police Department do? 

The Upper Darby Township Police Department enforces state and local laws. Police officers do not ask residents about their immigration status and do not assist with civil immigration enforcement. The Upper Darby Township Police Department does cooperate with all lawfully issued criminal warrants and court orders, regardless of the issuing agency. 

Should residents be afraid to call 911 or seek help? 

No. All residents should feel safe calling 911, reporting crimes, seeking medical help, sending children to school, and using Township services regardless of immigration status. 

What rights do residents have? 

Everyone in the United States has constitutional rights, including the right to remain silent and the right to refuse entry to their home unless officers present a valid judicial warrant. 

What is Township Council doing? 

Township Council is considering a resolution that formally affirms Upper Darby Township’s policy of not engaging in non-criminal federal immigration enforcement while continuing to comply with all applicable laws. 

How is the Township communicating with residents? 

The Township is sharing information through its website, social media, YouTube, Upper Darby TV (Comcast Cable Channels 5 and 1073), community partners, and multilingual outreach to ensure residents receive accurate information in languages they understand. 

Where can residents get more information or help? 

Residents can visit the Township website, contact Township offices, or reach out to trusted local community and legal service organizations for assistance. 

How will the Township respond if circumstances change? 

If new, verified information becomes available, the Township will provide updates through official channels. Residents are encouraged to rely on Township communications and avoid rumors or unverified sources.
