PUBLIC NOTICE

Notice is hereby given that the Zoning Hearing Board under “The Upper Darby Ordinance of 2010” will hold a regularly scheduled Public Hearing on Thursday, August 27, 2020 at 7:00 P.M. via an authorized telecommunication device due to the COVID-19 disaster public emergency that has been declared by Governor Wolf and Upper Darby Township. Anyone who wishes to provide public comment for this hearing can send an email to pamj@upperdarby.org and you will be provided a login code. The Board will consider matters within its jurisdiction and will receive testimony from persons who would be affected by the Granting of these Applications for Special Exception, Variance or Appeal from the terms of the aforesaid ordinances.

7-1 of 20 CONTINUED FROM JULY: Application of Marc Gottfried, for relief from Article III, Section 301 to allow the addition of a third unit apartment which is not a use permitted by right in the C-1 zoning district; situate 9006 West Chester Pike, Upper Darby, PA 19082. C-1 Traditional Neighborhood Zoning District. 4th District.

8-1 of 20: Application of Antonia N. Clinton, for a Variance from Article X, Section 1006-C for relief from rear yard setback to allow the construction of a wrap around deck with steps from the side of property to the back yard; situate 351 Congress Ave, Lansdowne, PA 19050. R-1 Residential District, 5th District, 5th Precinct.

8-2 of 20: Application of Piazza Family Limited Partnership for a Variance from Section 503-F.6(c) to allow the refuse area to be located 28.2 feet from a residential property in lieu of the 50 feet that is required. A determination that the proposed use as a Starbucks coffee store is not a “food establishment”, which is not permitted as a condition of approval of this Zoning Hearing Board in the Order dated December 18, 2014, in Application 12-1 of 14. Section 503-B., Table 3-1 designates “Restaurants-Drive through” as a permitted use, and Section 801-A, Table 8-1 of the Township Zoning Ordinance designates “restaurant” and “coffee shop” as separate uses. In the alternative, a modification of the Zoning Hearing Board’s condition to permit the use of the property as a Starbucks coffee shop. Any other relief necessary to develop the Property in accordance with the Zoning Plan attached to this petition; situate 5001 Township Line Road, Drexel Hill, PA 19026. C-2 Traditional General Commercial District, 1st District, 1st Precinct.
