Notice is hereby given that the Zoning Hearing Board under “The Upper Darby Ordinance of 2010” will hold a regularly scheduled Public Hearing on Thursday November 21, 2019 at 7:00 P.M. in the Municipal Building, Council Room, Second Floor, located at 100 Garrett Road, Upper Darby, Pennsylvania. The Board will consider matters within its jurisdiction and will receive testimony from persons who would be affected by the Granting of these Applications for Special Exception, Variance or Appeal from the terms of the aforesaid ordinances.

11-1 of 19: Application of YOUNG SONG c/o YSJS PROPERTIES L.P. for a Variance from Article VIII, Section 801 for relief from off-street parking requirements and Article III, Section 301 to legalize apartment on first floor; situate 8906 West Chester Pike, Upper Darby, C-1 Traditional Neighborhood Commercial District, 4th District.

11-8 of 19: Application of UPPER DARBY TOWNSHIP for a Variance from Article III, Section 301 to allow more than one primary use per lot for the purpose of operating a dog kennel to temporarily house and care for lost and stray dogs; situate 3 Kelly Street, Lansdowne PA, C-4 Commercial Industrial District, 7th District, 6th Precinct.

11-9 of 19: Application of DELAWARE COUNTY COMMUNITY COLLEGE for a Special Exception pursuant to Section 301 to permit a College on a portion of the property currently owned by the Archdiocese of Philadelphia which houses the Monsignor Bonner and Archbishop Prendergast Catholic High School. Applicant also seeks Variances from the following sections of the Zoning Code: Section 404-B as applied by Section 301 and Table 3-1 to permit a child day care center use on the Lot and to allow a child day care center together with the principal use of the Lot as a College; Section 801-B.5 to permit parking in the front yard; Section 401 as applied by Table 4-1 to permit the erection of a building and parking deck which are closer to the street line than the existing buildings; Section 401 as applied by Table 4-1 to permit the construction of an addition to the Main Building which will not exceed the existing height of the building but will be in excess of 35 feet; and Article IX, Section 902-G.1 and 902-G.1.b.iii to permit a CEVMS sign and a freestanding sign and wall signs which exceed 16 square feet. In addition, Applicant seeks such other relief consistent with this Application and the Plans and Exhibits submitted to the Zoning Hearing Board; situate 403 N. Lansdowne Avenue, Drexel Hill, R-1 Residential District, 3rd District, 3rd Precinct.

11-10 of 19: Application of BLUE DEVIL REALTY, LLC for Special Exception to allow outdoor dining and a Use Variance from Article III, Section 301 to construct a self-storage facility and to allow a mixed use for restaurant and office space; Variance from Section 501 to allow side yards of 5.4’ and 10’ in lieu of 15’, Variance from Section 801-A to allow 2 parking spaces in lieu of 24 required for parcel 2 and 16 parking spaces in lieu of 22 required for parcel 1 and Variance from Section 801-D to allow 0’ planting strip on parcel in lieu of 10’, and Variance from Section 502-E for required internal pedestrian walkways; situate 4221 Ferne Bvd, Drexel Hill, C-1 Traditional Neighborhood Commercial District,1st District, 5th Precinct.

11-11 of 19: Application of DINAVEL SQUARE, LLC c/o MUSI MALONE, & DAUBENBERGER,LLC for a Variance for relief from Section 902.H.1 to allow a billboard in the Recreational Zoning District and Variance from Section 902.H.4 to allow a billboard closer than 35’ to a street ROW; situate across from 1600 Garrett Road, Upper Darby, R-3 Residential District, on boarder of 5th District, 3rd Precinct.

11-12 of 19: Application of FORTJOY DEVELOPMENT, L.P c/o MUSI, MALONE, DAUBENBERGER LLP for a Variance from Section 902.E.2 to allow a ground sign greater than 6’ in height and relief from Section 902.G.1.b.iii to allow a sign in a residential district greater than 16 square feet; situate 250 Beverly Blvd, Upper Darby, R-3 Residential District, 5th District, 2nd Precinct.
